1. Acceptance of Terms

Welcome to DogTastik ("DogTastik," "we," "us," or "our"). These Terms & Conditions ("Terms") govern your access to and use of the DogTastik website and the custom dog jingle and song creation services we offer (the "Service"). By placing an order or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. Description of Service

DogTastik composes and produces personalized, custom-made jingles and songs about customers' dogs, based on details you provide about your dog's personality, appearance, nicknames, and other information (a "Jingle"). Each Jingle is created to order and delivered digitally.

3. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to place an order. You are responsible for providing accurate information when placing your order and for the security of the email address you provide, as we use it to deliver your Jingle and order communications.

4. Orders, Pricing & Payment

Prices for each package are displayed on our Pricing page at the time of purchase and are subject to change without notice for future orders. Once you place an order, payment is processed through our third-party payment processor, Stripe. We do not store your full payment card details on our servers. All prices are shown in US dollars unless stated otherwise.

5. Information You Provide

To create your Jingle, we ask you to submit details about your dog (name, breed, personality traits, favorite things, and similar information). You confirm that any information you submit is accurate and that you have the right to share it with us.

6. Delivery

Jingles are delivered as a digital audio file sent to the email address you provide when placing your order. Estimated turnaround times are shown on our Pricing page and are estimates only, not guarantees.

7. Cancellations & Refunds

Because each Jingle is custom-made and personalized to your specifications, it falls within the "bespoke goods" exemption under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, meaning the standard 14-day right to cancel does not apply once we have begun composing your Jingle. This does not affect your other statutory rights, including those under the Consumer Rights Act 2015. Please see our Refund & Cancellation Policy for full details.

8. Use of Your Jingle & Portfolio Samples

You receive a personal-use license to download, play, and share the Jingle you purchase. Unless you tell us otherwise by emailing dogtastik@gmail.com, you grant DogTastik a non-exclusive, royalty-free right to use your dog's name, breed, a description of their personality, and an excerpt of the completed Jingle as a promotional sample on our website, social media, and marketing materials. You may opt out of this at any time by contacting us, and we will remove the sample going forward.

9. Prohibited Use

You agree not to use the Service to submit content that is unlawful, infringes on another person's rights, or is offensive, defamatory, or fraudulent. We reserve the right to refuse or cancel any order at our discretion.

10. Disclaimers & Limitation of Liability

The Service is provided "as is" without warranties of any kind, express or implied. To the maximum extent permitted by law, DogTastik shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid for the applicable order.

11. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent changes. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of England and Wales. Any dispute arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales. If you are a consumer resident elsewhere in the UK, you may also be entitled to bring proceedings in your local courts.
